ENO NETWORK, AS A RESPONSIBLE AND RESPECTFUL COMPANY OF PERSONAL DATA, MAKES AVAILABLE THIS PRIVACY NOTICE, IN ORDER TO ENSURE THE DATA OWNER'S RIGHT TO INFORMATIONAL SELF-DETERMINATION.

I. DEFINITIONS

For ease of interpretation herein, capitalized terms shall have the meanings ascribed to them below. The same will be applicable to these concepts both in their singular and plural forms.

a. Privacy Notice: this document in its entirety.

b. Personal Data: any information concerning any identified or identifiable natural person.

c. Primary Purposes: purposes for which the Data Owner's Personal Data is Processed, that generate the relationship between ENO NETWORK and the Data Owner and are configured as strictly necessary for its maintenance.

d. Secondary Purposes: purposes for which the Data Owner's Personal Data is Processed, not necessary for maintaining his/her legal relationship held with ENO NETWORK.

e. ENO NETWORK: The entity that owns and administrates the platform where this privacy notice is exhibited.

f. Controller and/or Controller of Personal Data: A private natural or legal person who decides on the Processing of Personal Data. For the present case's purposes, ENO NETWORK is hereby held as a Data Controller.

g. Data Owner: the natural person to whom the Personal Data corresponds.

h. Transfer and/or Transmission: any communication of Personal Data made by the Data Controller to a natural or legal person referred to as a "third party".

i. Processing and/or Process: the collection, use, disclosure or storage of Personal Data.

II. PERSONAL DATA SUBJECT TO PROCESSING

By virtue of this Privacy Notice, ENO NETWORK informs the Data Owner that it will Process the Personal Data indicated below:

(I) Identification Data: Name, email address, phone number.

(II) Contact data: Email, phone number.

(III) Financial data: Payment-related information. The Data Owner is informed that ENO NETWORK will not Process sensitive Personal Data.

III. PURPOSES OF THE PROCESSING OF PERSONAL DATA

ENO NETWORK will Process the Data Owner's Personal Data for the purposes mentioned below:

A) Primary Purposes:

I. Identify the Data Owner.

II. Contact the Data Owner.

III. Register user accounts and enable access to ENO NETWORK’s marketplace.

IV. Verify wallet connections and ensure successful transfers of Non Fungible Tokens, also known as “NFTs”, on the platform.

V. Facilitate the minting of NFTs, including associating metadata and creator details.

VI. Allow the Data Owner to list his/her NFTs for sale or auction on the platform.

VII. Link Data Owner’s digital wallets to the platform securely.

VIII. Enable the platform to verify wallet ownership and process transactions linked to Data Owner’s NFTs. IX.

Calculate and distribute royalties to the Data Owner from resale transactions, where applicable.

X. Allow the Data Owner to have access to the functionalities of ENO NETWORK’s platform.

XI. Respond to and fulfill the Data Owner’s rights requests.

XII. Provide customer support for the Data Owner. XIII. Comply with applicable regulations.

XIV. Contact the Data Owner to inform him/her of changes made to this Privacy Notice.

B) Secondary Purposes:

(I) Include the Data Owner's Personal Data in surveys, studies, statistics, and reports.

(II) Improve ENO NETWORK’s services.

(III) To send the Data Owner information regarding ENO NETWORK’s services through the contact data provided.

IV. MECHANISMS FOR DATA OWNER TO EXPRESS HIS REFUSAL TO THE PROCESSING OF HIS PERSONAL DATA FOR SECONDARY PURPOSES

When applicable based on the regulations on the matter, the Data Owner who does not wish his/her Personal Data to be Processed for all or any of the Secondary Purposes contained in the previous section, must send an email to the following address [e-mail] with the subject "Refusal of Processing for Secondary Purposes". In the body of the email the Data Owner must specify for what purposes he/she wishes to express his refusal as well as contain his identification data for his request to be complied with.

V. NATIONAL AND INTERNATIONAL DATA TRANSFERS

The Data Owner is informed that ENO NETWORK will carry out the following transfers of his Personal Data:

VI. MEANS AND PROCEDURE FOR EXERCISING DATA OWNER’S RIGHTS

To exercise his/her rights, the Data Owner shall send an email to the following address [e-mail] , including the following information:

a. Full name and address.

b. The right wished to exercise.

c. Clear and precise description of the Personal Data of which he/she intends to exercise any of his/her Rights, as well as any document that allows to locate them.

d. If an update or rectification of Personal Data is requested, the modifications to be made must be indicated and documentation must be provided to prove the reason for the requested changes.

In addition, the application must be accompanied by the following documents:

• Copy of the official identification of the Data Owner or his/her representative.

• Document and/or information that proves that the Personal Data is in possession of ENO NETWORK.

• If the Data Owner does not personally submit the application, whoever does so must prove his/her representation, by means of a public deed or power of attorney signed in the presence of two witnesses, together with official identifications of both, Data Owner and his/her representative.

VII. SECURITY OF PERSONAL DATA

To guarantee the protection of the Data Owner’s Personal Data, ENO NETWORK undertakes to execute legal acts, adopt policies related to privacy, personal data protection and information security, enforceable within its organization, as well as to implement technological, physical and administrative security measures to ensure its correct Processing. ENO NETWORK stores Personal Data in databases with limited access, located in facilities controlled by high-standard security mechanisms. ENO NETWORK ensures that the Personal Data provided by the Data Owner will be considered and treated confidentially.

VIII. PERIOD OF STORAGE OF PERSONAL DATA

All the Data Owner’s Personal Data will be stored for the time necessary to comply with the purposes for which it was collected. Subsequently, there will be a blocking period prior to its cancellation.

IX. CHANGES TO THE PRIVACY NOTICE

This Privacy Notice may be modified at the time and manner determined by ENO NETWORK, in accordance with the relevant legislation. Thus, the Data Owner is informed that he/she can get to know the most recent changes to the processing of his/her Personal Data by consulting the latest version of this privacy notice through the platform. The Data Owner hereby accepts that his/her further use of the platform will imply his/her consent to the latest version of ENO NETWORK’s Privacy Notice.
